Terms of Use
Last updated June 24, 2026
These Terms of Use govern your use of Memoresse Moments (the “Service”) — the web experience that lets you bring a few photos, see how our intelligence enriches and organizes them, create a memory, and share it. The Service is operated by Memoresse LLC (“Memoresse,” “we,” “us”), a subsidiary of Memorythium Corporation. Memoresse® is a trademark of Memoresse LLC. Your privacy is governed by our Privacy Policy, which is part of these Terms.
1. What this is
Memoresse Moments is a web experience that lets you bring a few photos, see how our intelligence enriches and organizes them, create a memory, and share it. It is our cloud web experience and is not the Memories Lockbox; it does not carry the Lockbox's on-device storage guarantees (see Section 4). The Service is provided on an “as is” and “as available” basis, and features may change, be added, or be withdrawn.
2. Who can use it
You must be 18 or older to use the Service. By continuing, you confirm you are at least 18. The Service is not directed to children, and we do not knowingly collect information from anyone under 18.
3. Your content, and the permission you give us to run the Service
You own your content. The photos and the words you add (“your content”) remain yours. We claim no ownership of them.
What you let us do. To make the Service work, you grant Memoresse a limited, revocable, non-exclusive license to host, process, and display your content solely to operate the Service for you — for example, to run the enrichment pass (reading photo metadata and using AI to suggest context), assemble your memory, and show it to people you choose to share it with. This license exists only to deliver the service to you and ends when you stop using the Service or delete your content, except for copies people you shared with may still hold.
What you promise about your content. You confirm you have the right to upload what you upload, and that doing so does not violate anyone else's rights. Photos often contain other people; you are responsible for the content you bring in.
What we won't do with it. Consistent with our Privacy Policy, we do not sell your content, we do not use it to train outside AI models, and we do not share an understanding of one person with another without a deliberate, mutual opt-in. Our intelligence observes — it never declares.
4. How Memoresse Moments differs from the Lockbox (please read)
The Memories Lockbox is built around storing your memories on a device you own. Memoresse Moments is different by necessity: to enrich and assemble your memory in the browser, your content is sent to and processed on our servers and our AI service providers acting on our behalf. We keep that footprint minimal and temporary, we strip your account credentials before forwarding anything to providers, and those providers are contractually prohibited from training on your content. But Memoresse Moments is not the on-device, end-to-end-encrypted environment the Lockbox provides. Don't treat it as long-term safe storage; it isn't designed for that. The full sovereignty promise is what the Lockbox delivers.
5. Sharing
If you share a memory, the people you share with can view it through a link, and — depending on the feature — may react to it or contribute their own photos or words. Anyone who contributes keeps ownership of what they contribute, and contributed material stays within the circle of people already in that memory unless fresh consent is given. Only share memories you have the right to share.
6. Acceptable use
Don't use the Service to upload unlawful content or content you don't have rights to; to harass, harm, or violate the privacy of others; to attempt to access systems, data, or accounts that aren't yours; to scrape, probe, reverse-engineer, or copy our intelligence, the .mem format internals, or any non-public part of the service; or to interfere with the service's operation. We may suspend or remove access if you do.
7. Our intellectual property
The Service, its design, the Memoresse intelligence that enriches your content, and the methods behind it are owned by Memoresse LLC and protected by intellectual-property law. These Terms give you no rights in them beyond using the Service as intended. You may export the memory you create in the open .mem format; that export gives you your content and its annotations, not any rights in our underlying engine or methods.
8. No warranties
The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. We don't promise it will be uninterrupted, error-free, or that any memory or upload will be preserved. Keep your own copies of anything you care about.
9. Limitation of liability
To the fullest extent the law allows, Memoresse will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost memories arising from your use of the Service.
10. Changes and ending access
We may change, suspend, or discontinue the Service, or update these Terms, at any time. If we change these Terms in a way that matters, we'll ask you to review them before they apply to you. You can stop using the Service at any time and ask us to delete your content (see the Privacy Policy).
11. Governing law and disputes
These Terms are governed by applicable United States law. The specific governing law, venue, and dispute-resolution procedures will be set out in an updated version of these Terms; nothing here waives protections you are entitled to under the mandatory laws of your place of residence.
